unpaid rent from dss

HI everyone ,
slight problem with our rental income ,the dss (or whatever they call it now) stopped paying rent in october,due to not having tenancy agreement,we sorted this out,then when we rang the computer was down! so still no payment since before xmas.
when we called the other day we was told it would still take up to 14 days for us to get the last 3 months payment,bearing in mind we have a mortgage to pay and use this money to live off, we have now had to go into overdrafts is this legal for them to do? are they a law unto themselves ?cos it feels like it
