Credit report looks good but still letters coming through

I recently got my credit reports from Experian and Equifax (just signed up for Noddle).
The Experian showed good but it showed no debts linked to me and the Equifax only showed one. I have had other debts in the past and im still getting letters through from them, none of the reports showed when the last point of contact was made, i have no idea whats going on and im dying to get myself a DFW but i am so confused
Do i presume the other debts are Statute Barred, do i call them, or send Barred letters, very very confusing, all i want to do is clear all owed debts
Any help or direction would be such a great help

Thanks guys

Paul

  • Hi

when you got your reports, did you add your previous addresses or have you been at the same address for ages?

Be aware that if some prior creditors don't know where you are and you do this, likely they will get your current address when linked to the prior ones.

    Hi

Yeah i had to put older address's on in order to get the report, whgat i dont understand is that i have only one debt on my credit report but other letters are coming through, does that mean i still have all me debt or do i only have the one shown on my report

    Very confusing
  • That's the limit of my knowledge :)

Hopefully someone else knows why things vanished.

I only have one thing not on my report that should be and thats a closed to spending RBS credit card that seems to have vanished even though they send me statements and I pay it.

If they defaulted you on the accounts, and that was more than 6 years ago, then those accounts will no longer appear on your credit reports.

That doesn't necessarily mean they are statute barred however.

That will only be the case if more than 6 years have passed since you last acknowledged the debt in writing or made a payment.

You will have to try and work out if/when that was the case yourself. Your credit reports cannot help with that or be relied on to give that information correctly even if the accounts show.

    Thanks fermi

Unfortunately i have no idea what the timeframe was, im wondering if its worth sending a Statute Barred letter to them just to see if they are

    Morning all

Im guessing the only way to know as im not sure as to when the last acknowledged response from me was is to write the others a letter

Or does anyone know another idea, Apart from financially i didnt realise wanting to clear your debts could be so hard

    Many thanks

Just deal with the ones that are chasing payment.

If you're sure it is more than six years since you last acknowledged the debt in writing or made a payment, send the SB letter.

You could also consider sending the prove it letter first, to see if the debt collection agencies can prove you owe the debt and then the statute barred letter if required, but fermi and fatbelly always give good sound advice, so may be better going with there suggestions. I'll put the prove it letter below though to give you an idea of what it is. I know you have said you want to clear the debts, but from personal experience, this isn't always that easily dealt with.

    Good luck

    Dear Sir/Madam

    Ref: xxxxxxxxxxx

You have contacted us regarding the account with the above reference number, which you claim is owed by ourselves.

We would point out that we have no knowledge of any such debt being owed to The Loan Company.

We are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

We would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

We would ask that no further contact be made concerning the above accounts unless you can provide evidence as to our liability for the debt in question.

We await your written confirmation that this matter is now closed. Otherwise we will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

We look forward to your reply.

    Yours faithfully
