Accident at Work Claim

If it seems that your medical condition is unlikely to settle soon (& it is therefore likely to be a high value claim) then you can go to trial to deal with the issue of liability only. If that happens and they find in your favour you would then be able to request interim payments for a reasonable proportion of the likely value of the claim before it has settled.
True, but as I understand it (this is not my area of law, but it is a colleagues) courts are reluctant to do this and will only do so in limited circumstances. These most often being where the case has dragged on for many years without a medical outcome, or where there are issues of quality of life being impacted on negatively as a result of no resolution. In personal injury terms, three years is no amount of time at all - many cases are double this or more.
I doubt if this would be a high priority case yet - the bills are presumably settled as part of union membership / representation and not by the OP (this is usual); and the need for adjustments / medical equipment / quality of life costs will be minimal.
But otherwise I agree that the conversation needs to be had with the solicitors0 -
Still waiting for the solicitors to send me the Consultants report on my injuries. Not sure whether to phone them or not as I don't want to appear to be hassling them. Next week is the 3rd anniversary of my injury and still having problems, luckily I managed to get to stay in on light duties for 2 days last week at work due to my leg playing up, though I did get sent out on NYE as they were short staffed. I think I need to be going back to my GP and insisting on more investigation but he keeps fobbing me off with pain killers which I don't want/like.0

Just my twopennorth - bloody unions won't take cases on unless they think you have more than a 51% chance of succeeding, so you can take heart from that. (They refused to support me in my ET - which I won

Just a bit of an update. Received a phone call from the solicitor saying that someone has made a boo-boo and now there is a problem with my claim. Something to do with dates? Anyway I was told that I would'nt lose out either way as if it did'nt progress to court the Solicitors would claim off their own insurance.
Is this correct and has this happened to anyone else on here?0
