Help with a default notice!

Hi I have been looking everywhere for an answer and can't find one anywhere!

I had a debt with Very while i was a student and as a result i couldn't pay them which resulted in them passing the debt onto Arrow Global Limited... I have since found work and have set up payment plans etc. and was slowly rebuilding my credit score until one day i noticed that Arrow Global Limited but a default on my credit file.

I rung and asked and they said Very asked them to put it on there? Now i know i was probably meant to have a default on my credit file from Very (even though they never informed me) but they put on my file that the debt was settled (probably because they sold it on) but i didn't think a company was allowed to tell another company who the original debt wasn't with to put a default on my account, even when I'm up to date with them? surely Very should have just put the default on the account themselves instead of putting it as settled? :/

I also thought they had to tell you they were going to put a default on your credit file?

Is this all allowed? and if Arrow were putting the default on my credit file they should have told me?

thanks for any help!

The letters you got would of stated if you do not keep up payment they will take further action which could result in a default being placed on your credit file as well as T&Cs on the very account..

Yeah they probably did if they sent them lol, but what I'm wondering is why is Arrow Global who bought the debt allowed to give me a default notice even though the debt wern't with them.. i thought only Very would be allowed to do that :/

Very have probably sold the debt to arrow, so Very mark the account as settled and Arrow have issued the default.

How long from making no/less than contractual payment did the default appear?

Whats the date on the arrow default?

There are timing guidelines for issuing defaults, if you have time to read. Also tells you who should be updating the CRA entry and when:

    http://www.ico.gov.uk/upload/documents/library/data_protection/detailed_specialist_guides/default_tgn_version_v3%20%20doc.pdf

Edit: Forgot, on your original point, a default notice has to include the action you can take to avoid the default. e.g. if payment of x is not made by date y then a default notice may be issued. Again, has to be within a reasonable time f rame.

Ask them for a copy of the default notice (Very), and if they refuse you can always submit an SAr.

    How old is the account?
