Holiday Pay

Hello all,
I am on a 'Fixed Term' contract due to end on 31st December. I started in the last week of October (24th). My contract says I am entitled to 23 days holiday plus 8 bank & public holidays.

I want to take this as accrued holiday pay. I will be working the alternate date for Boxing day 27th so I'm thinking I should get paid for this too. I am thinking in total I should get paid roughly 5 days holiday pay.

I asked someone at work about this and he said it is a case of use them or lose them. There is no time off left on the calender before 31st of December, any I want it paid as holiday pay. He is not a HR person and I think he is talking nonsense.

Can you let me know if I am correct with regards my calculation on holiday pay. Thankyou in advance.

    What is the normal holiday year.

    you worked 10 weeks
    10/52 * 31 = 5.96days

    Technicaly if you don't take any of the holidays during the 10 weeks you are due more.

    31 days is 6.2 weeks so full time workers acrue over 45.8 weeks

    10/45.8 * 31 = 6.77 days

    If you take some of the holiday then it will be between the 2 numbers.

    You are right.

    The firm could however insist you take some of the holiday before you leave effectively bringing your leaving forward. There are rules about how much notice they have to give to force you to take holiday. I THINK it is twice the length of the holiday but I'm getting a bit rusty on some of this.

    Obviously if they don't they will have to pay you for what you have accrued after you leave.
