  • To be honest I am totally shocked at the behaviour. I have had debt issues for sometime now but I have never had this level of harrassment over a payment that is less than a month overdue and for £80. I am completely surprised by it. I don't seem to have had any further calls as yet, but the last time he called he said (after shouting down the phone at me) that he was trying to help and that he didn't want all the money back today (I told him he'd have to wait until tuesday before I can give them a token payment). I am now very worried that when I get paid they will just take it all so think I'm going to go and cancel my debit card.

What a nightmare. The last thing he said to me (or shouted to me rather, was - DO YOU WANT ME TO NOT BOTHER SETTING UP A PAYMENT PLAN?! JUST REFER THIS TO THE SOLICITORS AND TAKE YOU TO COURT!!!!!!) I didn't even get the chance to answer - he just said "fine, I will then". So I can only presume that is what they are doing.

I don't think that will be the last I have heard from "Hussain" as he calls himself.

I'm going to do something about this. Just have to wait until payday because at the moment I couldn't afford a stamp.

Am nearly 6 months pregnant could do without this stress!!!!!!!!!!!!!!!

Have you not cancelled your debit card and closed the account yet?
The payday loan company will certainly take the full amount as soon as money goes into your account (they are probably trying to take funds everyday to see when your income hits). Even if you cancel your card most payday lenders can (and will) take the full amount straight out your bank - its written in the small print somewhere.

Payday loan companies will not negotiate until they can't get funds any other way. You need to open a new bank account ASAP. And cancel your debit card. Its probably too late to get your wages paid into a different account - but you need to get your wages out the account as soon as it goes in and hope you get there in time before the payday loan company (some people stay up all night watching on online banking so they can transfer them out as soon as they hit).

Have a read of this thread -Dealing with Payday Loan Companies

  • I asked my employer to pay my wages into a different account I'm just in the process of getting my bank to cancel the transfer I set up to the tainted account for my bills. It normally goes in same day and I can see them draining my bill money dry. The bank think this will be cancelled in time I'll just have to pay my other bills seperately.

I am going to read that thread now, thank you all for your replies, it has put my mind at rest a little to know that they shouldn't be dealing with this in this way and will give me more ammunition for my next barrage of phonecalls!

    Good.
Just one thing - are the new account and the 'tainted' account the same bank or different banks? Only if they are the same bank its not unheard of for bank to pay out of old account and then offset funds from the new account to pay off the unauthorised overdraft they created on old account.

Hopefully he's given up on calls at least for the weekend now.

  • Hi mojo
I have nothing to add to what's already been said but hope that you're able to get the bank account thing sorted quickly and that the harrassment can be brought to an end. :grouphug:
  • Follow my advice. Record the calls. Retain the evidence. Go to the police. Go to a solicitor (Mr Phillips). Turn this "debt" into a profitable venture in the civil courts :)
    B.A - Shut up fool!
  • Which company is this? It would be useful to know in case in the future someone is in the same situation and searches on the forum. If they're doing it to you they're probably intimidating lots of people.

i would definetly report to the police and jot down the number...
  • You need to start recording these calls. Rather than pay off the loan to him, I'd invest in software to do this if ou can. You should bear in mind that it is a legal requirement for you to inform him that you intend to record the conversation, but just do this whilst he is shouting and he probably won't be listening anyway.

When you have enough "evidence" of this harassment, I suggest you take this matter to the civil courts and sue for a MASSIVE amount of compensation for the large amont of distress he has cased. If you need a solicitor, I recommend L Phillips QC. He's expensive, but he does the job damn well every time!

sorry but i find your reply slightly......don;t know what the word is. how on earth is the op going to fund an 'expensive ' solicitor when she says she can't afford a stamp. surely, although how horrible it is, would be a lot easier to pay it off, record the evidence and go to the police and the FSA
