made redunadant whilst on sick leave??

My sister has just told me that her OH has just been made redundant. Last week he had his tonsills out and was put on 2 weeks sick leave, but he was hoping he might be able to go back after a week on the sick.
Is his work place right in doing this or does he have any rights? He only started this job last year.

How long has he worked at the company?
If it is less than a year he can be dismissed without a reason (apart from certain types of illegal discrimination).
In these circumstances he is entitled to at least a week's paid notice (or more if specified in his contract) plus he must be paid for any untaken holiday.
Technically it is not a person but a post that is made redundant. Yes, this can happen whilst the post holder is off sick but there are procedures to follow. As stated above if he has been there less than a year then it it largely irrelevant whether they followed them or not.
He would need more than two years service to qualify for any redundancy pay but this does not actually sound like a redundancy situation.0
