Can I request to leave early when being made redundant?

Hi everyone,
About a month or two ago the entire team was told that their positions where insecure and could be made redundant, after which we was all taken in one-by-one and told of positions that will be available in the new year should we wish to apply.
I decided to take redundancy and my finish date was set to the 31st Dec to fall inline with my retention bonus, but I would like to leave before hand as my position has truly become redundant and they are now using my skill set for next years projects instead.
Having done a quick search I stumbled on this thread from 2008

Does the above counter notice still stand and would this mean I would still get Decembers wage or would I have to waive that? I'm just wanting to way up the options before taking unpaid leave of December as i'm not prepared to do further work for projects that are not due to be started until next year when i'm suppose to be redundant.

I don't see that as an issue you should be overly concerned with
If they pay you for 8 hours, do 8 hours of whatever they want you to do [within your contract]
Don't get all involved with the politics of it0 -
I'm no expert but when I was made redundant we were told that we could go into work if we wanted to or we could decide not to but during that time we were still employed by them and couldn't start a new role until officially redundant and they would pay up until then.
I would suggest that you speak with someone in HR or something who would know if you could do this.0 -
If your role is redundant, talk with HR about finishing dates - they may be so pleased to work with you on not having to force anyone out who doesn't want to, that they will help0

Counter notice does not mean you get paid for unused notice, just protects the redundancy payment.
Try to negotiate PILON to leave early or garden leave so you don't have to work.
If you are trying to get new work and find something then counternotice might be the way to go BUT watch out you need to be within statutory notice.0 -
Further to the other comments, just have a chat with HR to see if you can go on garden leave.
Just explain that you want to concentrate 100% on getting a new job for the new year and that you are finding it difficult going into work each day.
I wouldn't give them counter notice or anything like that - and I certainly wouldn't say that you don't want to work on projects that will continue after you leave !
Either way, with 6 weeks to go (less any holidays ? - Christmas ?), I wouldn't do anything too exciting in case it jeapordised my redundancy payment.0 -
Counter-notice cannot be served unless you (a) have another job to go to and (b) are within the statutory notice period.0

Of course, it's more a frustration on my part as i've already requested gardening leave as I knew this would happen as we have already completed all projects for this final quater.Either way, with 6 weeks to go (less any holidays ? - Christmas ?), I wouldn't do anything too exciting in case it jeapordised my redundancy payment.
Very true, but moral has already been killed way before the redundancy and i'm now weighing up the pro/cons of loosing a months salary for the sake of my own sanity and a decent xmas.Counter-notice cannot be served unless you (a) have another job to go to and (b) are within the statutory notice period.
I will be within the statutory notice period at the end of this month which is why I was wondering if a counter-notice could help.
Thank you all for you thoughts pretty much what I expected, now I need to decided if its worth the extra stress for the sake of a month salary or to walk away now.I learned about debt the hard way and the best way

Be very careful, if you try to walk away before 31/12 it may be your redundancy payment and retention bonus that are at stake not just a month pay.:j Proud Member of Mike's Mob :j0
