Working while on holiday.

Hi

A friend of mine at work has been off on holiday last week. While he wa off work he helped a friend of his family with a bit of work. This wasn't for cash or anything. But where he was his boss from his main job saw him and has now threatened him that he might lose his job.
Now can he do this. If not could anyone point me in the right direction so I can print something off the Internet for him.

  • Was the work for the family friend in a similar line as the main employer? That is, would there be a question of competition here?

    No he was helping him put some boxes away in a warehouse and the main boss happened to be using the same warehouse.

    I have a clause in my contract which states that if I want to do work for anyone else I need special permission to do so (i.e. my job is classed as full time, and I'm not allowed to work outside of that). Your friend may have something similar? But, if he was just helping someone out, for no money, then I can't see a problem here. I'd suggest he talks to the boss and explains what he was actually doing.

    Except that he has to prove he didn't get paid for it.

    Many people fall foul of non work clauses because they just ignore them or fail to realise that what they are doing may fall under the terms.

    Work could be many things, not just paid, member of a comitee, volunteer, scout leader, PTA are all work that could be against a clause.
