Is it legal to Blacklist Agency Staff?

Asking for a Friend of mine, are Agencies allowed to contact other Agencies and basically Blacklist someone, My friend was a Forklift Driver at 1 Agency but because he didnt pass his Test ( he has both Valid Licenses, but never passed the Entry Forklift Test, that all new Employees do) so they have blacklisted him.

I am having trouble understanding this - if he has the required qualifications then how can anyone have blacklisted him, and if he doesn't, then he hasn't been blacklisted - he has been told he doesn't have the required qualifications for the job he wants.

It depends on what type of licence it is. If it was an in house certification it will only be valid for use when working for that employer. Certainly many employers who put staff through a forklift certification tend to go for that type.

If it is a RTITB it applies anywhere however they are time limited and it may have expired.

Also it sounds like the agency do their own competency test prior to offering work and that he failed this and TBH when he could be moving 2 tonne pallets 20ft up in the air would you want to employ someone who has?

Certainly as a lorry driver, I've had to have several driving assessments before being offered work with agency clients.
