who do i pay?

Oh has a debt with T-Mobile for a contract phone from about 2 years ago. He has been paying £10 a month for about 12months and before that was paying £20 a month for about 6 month and also made bigger one off payments, the balance started at about £300 and it got passed over to Moorcroft Debt Recovery who he has been paying the £10 to every month.

Anyway the balance wasnt going down so i asked them for a statement about a year ago as the balance was the same as when it started and on there were charges added on wen passed to them. Shortly after receiving this i got a court form which was resolved quickly by agreeing to £10 a month.

Anywayyyy oh has spoke to them today as the balance is still £230 and they are saying he has only paid £80 of so are sending another statement out!

My question is: every month when he pays the £10 he receives a letter from tmobile saying thanks for payment your balance is now.. and its about £100 less than that of Moorcroft.

so who does he owe the money to? if he were to pay T mobile direct what would happen? we wanted to get rid of it and offered a full and final to moorcroft which they declined and started court proceedings!!! x

  • If the debt is currently with Moorcroft thats who he should be paying. Once the debt has been passed on you no longer owe T Mobile anything.

    You need to get a statement from T Mobil including all payments, dates, ballances etc. Id also inform Moorcroft you have been paying T Mobile direct.

    When you did the court thing - was that with T Mobile or Moorcroft?

    It "sounds" like you were originally paying T Mobile who were adding late charges/interest etc. It was then passed to Moorcroft who you paid £10 per month to. It then went to court and the agreement was to pay £10pm but this has been going to T'Mobile. Therefore the only payments to Moorcroft were the intial £10 ones, and why they think youve only paid £80.

    You need to establish if the debt has been sold to moorcroft or if they are just acting on tmobile's behalf. It sounds like the latter in your case. Have moorcroft ever sent a notice of assignment from tmobile?

    Might be worth phoning up tmobile collections and seeing if he can deal directly with them and make his payments to them. If they say no then all payments must go to moorcroft, and you need to ask tmobile to inform moorcroft of the additional payments he has made direct to them since moorcroft took over.

    thanks, im gona write a letter now as they obviously dont listen over the phone! the letter received says:

    AS requested please see below your statement of account

    28/10/11 payment received £80.00

    and that is it! all the payments have been paid to moorcroft so dont know where they have gone! x
