sickness entitlement

My husband is about to have surgery on his foot,

The Dr states he may need to have 6-8 weeks off work while he recovers, at first we thought that was fine as company handbook (dated Aug 2010) stated that employees at his level of service can have 8 weeks full pay while off sick
Unfortunatley his contract states different, (perm contract started Sept 2010 before that he was working on a temporary contract) that says we only have 4 weeks full pay sick entitlement.

Is there any way we can "convince" the company to extend his sick entitlement to the same level as the other employees or are we going to have to suffer the extra time he needs with SSP ?

    I would start by asking HR why there is a discrepancy between the two documents and asking which one is correct.

    We have, Employess who signed onto a perm contract with the company before 1st sept 2010 have the sick entitlement stated within the handbook,
    those who signed after have the new terms.

    Apparantly HR couldnt be bothered printing off a new batch of handbooks with the new terms

    So the contract terms apply, clearly.

    we didnt know about the diffferences until we started looking into the sick entitlement and then noticed the discrepency

    Aww, sweet!

    Sorry but no... if that was the case then there'd be no individual salary negotiations. In my office I get 5 days sick leave a year :eek: while some of my colleagues (on my level and more junior) get up to 3 months.

    What sort of work does he do? Is it office based, retail, warehouse or driving? Two months seems a long time to have off work for surgery on one foot. I had surgery on two and was back at work after two weeks - but that was office based.

    Apologies for the late reply.

    He works in a factory but has to wear the boots provided by the company for H&S reasons. (some nasty products made there)
    He's on his feet all day, and his op is a new joint so he'll need a while to make sure everything ok and that he can wear his boots comfortably.
