Hmmm, if it turns up, it turns up, if it doesn't, it doesn't and I've lost nothing - but if anyone was being finicky, as far as I see it, according to their T&C's, by sending the confirmation email they HAVE ACCEPTED MY OFFER OF £0 FOR THE GOODS AND SERVICES REQUESTED

    Dear Customer,

Thank you for your recent order for the O2 Ice handset through our website. Due to a system fault which we experienced on our website at the time of your order, we will unfortunately be unable to despatch your order.

We sincerely apologise for any inconvenience this may have caused you. The error has now been resolved and should you still wish to order this great value phone it is available for £69.99 at the following address:

Now, as a semi-attentive contract law student, I think the fact that you have paid £0 for the phone leads to a contract not actually being formed. To have a valid contract, one requires an offer and acceptance, as well as some form of consideration (ie. payment). So I reckon there isn't much legal basis through the T&C.

Well I've just got the out of stock e mail, so I stuck my neck out and phoned them on 0161 7055000 and got passed through to hardware orders.

I gave my order number and was told that it was despatched today via DHL for delivery!

I asked how the out of stock e mail came to me and they repeated what they told me and mentioned that the out of stock e mail may have been sent when they ran out of stock, but they may have got more stock and hence despatched mine.

    We'll see......

Further to my last post today came and went but the phone didn't.

I phoned this morning to try to get a consignment no and they gave me the wrong no.

I phoned this evening to expadite it and was told that the phone was originally out of stock. When I asked how I came to receive the e mail saying that it was dispached to the shipping dept etc.... I was told that that e mail was sent out automatically. So much for O2s accuracy of information ;)

The gent I spoke to this evening checked to see if the phone was in stock, which it was and said he has re ordered it for me and I should receive it in a few days.

    We'll see....
