Former employer with-holding holiday pay

Very briefly, under my old employer, i was receiving study support towards professional qualification. I signed a document to say that i would pay back a certain amount if i left the co before i finished the course.

I resigned about 7 weeks ago, left about 3 weeks ago. On leaving i had 9.5 days holiday owed that i asked to take off for study purposes, they asked if i minded staying to 'hand over' my duties, and receive the holiday as paid. I agreed and duly did what was expected.

The question of repayment of study was also asked. My manager and i drew up a repayment plan, which we both signed and agreed on, both keeping a signed copy. I expected to be paid remaining salary + holiday as agreed, and hence expected a specific sum to be paid last month.

The company is quite big, well, a multinational. I didn't receive the holiday pay as expected, due to HR with holding payment due to me owing them for study.

What i need to know is, does the agreement i drew up with my Manager replace the agreement i originally signed with regards to the paid study? the original agreement stated i accepted them deducting any money owed from my salary upon leaving, i thought that as we had made a separate agreement, this took place of the original.

Any legal eagles with any advice?

    If the repayment plan is the implementation of the study agreement, it should stand - as you waived leave as part of the deal. If it is in contradiction to the study agreement, you have a problem.

    the study agreement stated that i accept that they will deduct from final salary, the agreement with my former manager was secondary to this

    Thanks for clarifying, looks like ill have to grovel. Even the fact i was lead to believe otherwise upon leaving wont stand for anything? i know i agreed something originally, but i also agreed this later on their offer for a repayment plan?

    Im not disputing the repayment, im happy to do that, its just from a cash flow perspective
