Lost loan agreement
Hi there,
I am currently in dispute with my bank and a number of issues:
1. Bank charges.
2. Early settlement charges.
3. PPI
I have recently been informed that the bank cannot find my loan agreements, I cannot remember actually signing one, I think it was all done over the phone.
Question: Where do I stand if either they cannot trace it or I didnt sign one?Anybody help please.

You can ask them to give you any information that they have on you. The data protection act 1998 allows this, it costs £10.
Go to the reclaim charges section of this site and go from thereI am desperate for acceptance, please hit the 'thanks' button.0 -
You would not have got the loan without signing an agreement, which would have been sent by post after sorting it out over the phone. The bank must have a copy otherwise they would have no grounds for you to pay them anything back. Say to the bank you want a copy of the agreement, it might cost you.0

tommy,
not strictly true.
Depending on when the loan agreement was taken out a verbal agreement may exist. Cymru - you would have been sent paper copies of any loan agreement though.
Similarly payment of installments is evidence that a loan existed.
Why do you need the loan agreements anyway?
From their systems the bank should be able to tell you what the loan amount was, how much the PPI was and how much you have been charged for penalty fees etc.
R.Smile, it makes people wonder what you have been up to.
