extended roles pay entitlement legal help!

Hi need some help please,
I've been a first aider in my job for the last 2 and a half years and did not get paid any extra for this. In a meeting last week the topic of payment for first aiders was brought up with a member of the Head offices HR team. They told me that other workers within the company were getting 11p an extra per hour for being the first aider.

Since this I've been given the increased rate but I was wondering if I am entitled to get the 11p an hour back dated for the duration of my time being the first aider? My boss told me agressively that I had no chance, but I'm not sure if he's fobbing me off to save on his wage bill.

Any help will be greatly received.

    Good luck is all I'll say. There is no automatic right to be paid the same. You're about £400 out of pocket for the 2.5 year period after tax however if you are on tax credits that may end up being more.

    It depends on how much you want to get your bosses back up for £400.

    That's the first time that I have heard of getting extra pay for being a first aider (and a free first aid at work and qualification)!

    Fairly common in unionised environments in my experience - especially where there is actually a legal requirement to have qualified first aiders available at all times when the premises are occupied.

    Its been common in most jobs I've been in. Usually its a low amount up to 50p/hr.

    Give it a go. If all other first aiders are getting it, that suggests you should too and it could just be an admin error that you didn't. Even if there is nothing in writing from the time of your appointment as a first aider, and nothing in your contract or the staff handbook etc to say that first aiders get extra, there could still be an argumnent that custom and practice suggests you should get it - at the very least, their reasoning (or not) will become clear early on.

    Start with a letter to HR, then a grievance, then an employment tribunal claim. Stop when you get the money or when you feel uncomfortable taking it any further.

    Both, he doesn't want to increase his wage bill and you have no chance (probably).
    There is no legal entitlement to extra pay for being a First Aider.
    The only chance you would have is if your contract or staff handbook said you would get more for being qualified and this had been overlooked.

    Other way round in my experience although the amount of extra pay is normally quite small.

    Recover the arrears of pay then withdraw future first aid services. Let your boss provide it.

    With the exception of the NHS, most public service employers will recognise the first aider with a pay enhancement.
