He has never been told about the company policy of using mobile phones whilst driving.
Unless the company puts more restrictions on him than the law requires he doesn't need to be told of their policy.
If the company require him to answer the phone whilst driving then they need to provide him with the necessary equipment to do this legally.
Even then, if he were to be involved in an accident, he could possibly be guilty of driving without due care and attention or even dangerous driving so beware it is not a "get out of jail free card".
Personally I think ALL mobile phone use whilst driving should be banned and anybody caught using a hand held should receive an immediate 12 month minimum ban like drink driving.0 -
Just to say that because he has only 5 months service, he can be dismissed for any reason, or no reason at all (provided the employer doesn't breach the anti-discrimination laws).
I cannot understand why he took the call. Using hand held mobiles while driving is illegal, end of. Okay, it was to say that the job had been cancelled, but it is ridiculous to suggest that he would have continued to drive another 200 miles to a cancelled job if he hadn't taken the call. What was wrong with driving to the next service station, or leaving the M'way at the next exit and finding a safe place to take the call.I'm a retired employment solicitor. The company I used to work for installed hands free kits in cars if that the person was deemed to need a mobile for company use.0

You, as the driver's partner would receive a phone call from a traffic officer or more likely a visit from traffic officers informing you of an accident involving your partner because he was on the phone whilst driving.0 -
