Why be offended , this is a media forum and i thought the ideal was always to get ind advice .
I can only tell you what my OR indicated for my future job roles and expenses that i would occur to do such. For example: i can get a fab job in London but i dont think im gonna be allowed the 2nd home expenses as well, id need a 2nd home as the role in interim and not secure enough to relocate.if only life was a box of chocs0 -
Offended as I used to work for the insolvency service, conducted interviews, and dealt with assets (including cars). And I did care about the consequence and needs, as did everyone else in the office where I was based.
Also, I suspect you did not speak to your OR, but to an examiner.0 -
Depends on personal circumstances - without having the OP's file in front of me it's difficult to say, but I have seen this allowed in other similar cases.
So there is nothing black and white.
What i was trying to say and i dont have the wealth of wording as to how you like to say it for forum purposes, its a chance to give up one job and take another when there is def no guarantee,
Also you say my post to get advice from ACAS is incorrect.
FSA - how many jobs are associated to the FSA, i said take advice from ACAS because they are the experts in employment concerns, - their employer could be talking total tosh to put the wind up them.
Who is to say there are not other roles the OP could be redeployed into etc because of BR.if only life was a box of chocs0 -
Hmm this is an interesting one and I'm not sure if there's a hard and fast ruling. I used to have similar and it was taxable but non pensionable.
Playing devils advocate here but could the or not argue that it is acceptable to rent a car but that it should be the cheapest car possible?
Eg acceptable to rent a small car like a Fiesta but not an Audi etc.

I didn't say that the advice to speak to ACAS was incorrect, but that if the job was FSA regulated then you cannot legally do that job after BR.
Also, it looks like it is the current company that is redeploying the person?0 -

Did you also work at the Hagley Road Bham site will the trillions of interims they employed , i note your location is West Midlands
What i do find off putting and does offend me is that so many current or ex OR staff claim to give advice on this site , then love to say who did you speak to , was it admin, was it a examiner etc , it treats the average poster as a numpty .
Mabe you would like to share with the site who we should be speaking to , so we dont make the obvious mistakes in god forbid accepting what the OR offices says over the forum . For me i will start it off with

Again, difficult, but the company has certain criteria that has to be met. So do you tell the person no, so they would effectively be unemployed. Or do you let them keep the hire car, so they continue employment and would be able to contribute to an IPA?0 -

No, I did not work in Birmingham.
I was an examiner - same as the person you would have had your interview with.
Each case has a case officer, Examiner, Assistant Official Receiver and Official Receiver allocated to them. The case officer deals with the admin, the examiner conducts the interview, writes up the case, makes suggestions as to further investigation, deals with some assets. The case is then passed to the AOR to review and approve/make amendments on.
The OR is more like an MD, and it would be very unusual for anyone to speak to them direct.0 -

Well i would also think the same, but not all journeys are doable in the cheapest car, i was trying to say that if a essential car user is given, it doesnt mean all of that would be exempt its given to assist with the travel costs entailed inc tear and wear and high mileage and is part of the salary payment and taxed. Its a cheaper option always because of the tax implications and costs of having fleet cars when providing a company car.if only life was a box of chocs0 -
I am not looking to make any money out of the allowance, and if that means driving a small car, then so be it.
I do want to work though, but at this rate it would be easier to sign on and not care.
I cant believe I have just written that, but thats how it feels.
As it stands the OR will likely get around 650 pm from my income surplus IPA, Plus the surplus from the car allowance (50pm?) plus any commission i earn (likely 500 per month)
At this rate it would be easier if they hung me upside down and slit my veins......0
