Thank you all for the replies they have been really helpful, as well as asking the question here my boyfriend also called acas today.

Partner spoke to his boss today and asked what the procedure is in the future if it was to happen again and he was told to use his common sense, so that clears that up.

I think the thing that has got to my partner is what a few people here mentioned, what if another four customers had followed the first customer, is he supposed to stay there until 1.30? 2.00? unpaid? When is the cut off point?

Thanks again for the help, I appreiciate it.

Well he clearly needs to ask his boss this question doesn't he. To be honest, using his common sense seems like fair advice to me. If he just walks away saying "We're shut - not my problem", he is not exactly showing the employer's business in good light. But if he says something like "I'm sorry, we're closing now and we're cashed up but I can take some details and get back to first thing in the morning", then that is using his common sense. If he finds it is then happening frequently he could approach his boss and ask to be paid for the time. But really, I think he needs to be a bit flexible here. Having an attitude that it is not his problem is not really helpful.

Read the OP. The boss wasn't there. And what difference does it make anyway? The OP has to deal with the consequence of what his employer is saying, not just sit there asking childish playground questions. What next - "You started it"? People come on this board looking for proper answers to real problems not just to have a gossip about what should and shouldn't have happened in the first place.

The OP just states that one other person was there, that may or may not be the boss.

Once he had finished it was about 12.40 so work had already finished for the day and everyone else apart from one other person had gone home.

He went to his locker upstairs and got his coat etc then made his way back down and was about to leave (12.45) when the other guy who was there came to him and told him a customer had just showed up and was waiting for him at the front desk.

The fact of the matter is he was not the only one who was there, the OP said that a colleague went to get him to tell him that a customer was in the shop. The colleague regardless of if he is the boss or not should have told the customer they were closed and not put it all on him. The shop was closed and had been for a number of minutes. They then should both have been hauled into the managers office after said customer complained.

(As for advice - some of your posts are less than helpful but I won't go into that because that will not help the OP).

When I worked in a shop many years ago, there was ALWAYS a boss on site.

    You haven't wasted anyone's time.

The post wasn't aimed at you.

I hope everything is sorted :)

I certainly wasn't having a go at you - you have raised a legitimate issue and some of us have tried to give you sensible advice.
