Capquest Debt Recovery

Please can anyone confirm what I found on the following web site today?

The general jist of the forum explains that Capquest, and I don't know if this applies to all debt recovery agents, are not legally allowed to take you to court to reclaim your debt. The impression I get is that because they buy the debt from the original Company they do not have a 'proof of debt' and if they do take you to court they can only claim for the amount that they bought the debt for which is usually around 5%.
I have received many threatening letters from this unpleasant Company and would be interested to know if anyone here has heard of this.

I would also like to hear if anyone has any knowledge on this as my boyfriend has been getting letters from them for the last couple of months threatening to take him to court for a debt that was apparently just under 6 years ago and he claims no knowledge of this as he was out of the country working at the time. We're currently working on a way to approach this.0

If this turned out to be true, then it would be the end of debt collection companies!!!!
Also, I think :money: himself would have picked up on it by now, but its well worth exploring the concept.
