ccj - help needed

    Yea, that info only relates to when you have been ordered to pay, say 50 installments of £50 per month, and it's called a Variation, that's not Redetemination.

    If you have been issued a CCJ in installments and simply can't afford the repayments, it's better to go for a Variation Order than a Redetermination Hearing as that could go against you but the Variation Order usually won't.

    In the case of installments, Redertmination is there for the Claimant is they don't agree with the Judgement.

    With a forewith judgement, you are not given the opportunity to pay by installments, either because the Creditor has requested this (like mine) or the Judge or Clerk is an utter !!!!!!, you have to pay the full amount within the 14 days or have a faceoff with the Bailiff.

    The only way to avoid this is to apply for a Redetermination Hearing, sometimes the DJ will change the order without a hearing, other times they will schedule a hearing and both the Claimant and Defendant will discuss the matter with the Judge, usually in Judges's Chambers.

    It looks like I am a few days ahead of the OP in the process, and i'm due to call the Court tomorrow to make sure everything is ok, so if I've messed anything up I'll sure let you know.

    Got a letter from the Court this morning:
    To all parties

    This claim has been transferred to the XXXXXXX County Court for that court to deal with the defendant's application for redetermination.

    So it seems where a Judgement to pay full sum with XX days is issued, a simple letter requesting Redetermination is all that is necessary.

    I've got about 30 letters from Solicitors and Loan companies now in the shredder asking if I need help dealing with my recent CCJ? doh!
