Job Seekers?

Hi,

My daughter has been made redundant, and her notice period completes today. However, her boss has asked if she would be prepared to come and work for 2 days a week (15 hours total) until the end of the year. She will be paid £8 per hour for this work. Can anyone tell me if this will mean she is no longer able to claim job seekers allowance?

    I think you can still claim jobseekers until you are working 16 hours a week though you have to continue jobhunting and if she's claiming income based she will have her JSA amount reduced pound for pound earned after a disregard of £5.
  • So if she is earning £112 per week (14 hours @ £8 per hour)
    She will get £5 a week job seekers - is that what you are saying?

    No. Given those figures I do not think she'll receive anything from JSA. As far as I understand the system if your daughter is an individual with no dependents claiming Income Based JSA then her earnings are subject to a £5 disregard.

    This means that when working out what payment is payable they take £5 from the weekly earnings and subtract the remainder from the normal JSA payment.
    So, if she would normally receive £67.50 from JSA but earns £112 a week the JSA payment will be worked out as following:

    £112 - £5 disregard = £107. This is higher than the £67.50 JSA payment so she will receive no money from JSA.

    It may be worth seeking clarification from the Benefits Board but I believe this is how it works.

    From the DWP Decision Maker's Guidance
    25014 When calculating whether a claimant is entitled, the DM should

    1.calculate the weekly amount of income following the guidance in this part and
    2.then add any tariff income from capital.

    25015 If the claimant's income in the benefit week is more than the weekly applicable amount, the claimant is not entitled to JSA(IB) or IS.

    If she's been working for a couple of years before being made redundant and paid NI during that time, then she would get contribution based JSA for 6 months which is not dependent on other income or savings. She should go to the job centre and ask them.

    Is it doing the same role?

    If it is then the role is not being made redundant and then she can asks some questions.

    They disregard £5 then take £1 for £1 from the JSA when your working, on £180 a week shes earning too much to get JSA. She can still apply for council tax / housing benefit and a card to help with NUS costs as shes on a low income, if she lives with a partner they'll take the partners wage into account.
