Rules on Exchanges that don't Arrive.

Hey everyone, Newbie here :P

I bought a Computer monitor about 2 months ago, and it stopped working recently, I contacted the online seller asking for a refund and they said they would arrange to have the faulty one picked up and exchanged, after reading this article

(had to use code tags because new users can't post links), I realised I couldn't ask for a refund and accepted the solution.

However the replacement product which they told me over the phone would arrive today (explicitly stating the 3rd of November) hasn't arrived. If say, it didn't arrive tomorrow or even the next working day, could I then claim that it wasn't delivered when I asked for it and claim a full refund.

I know I am jumping the gun a bit, would just like to know my options are, I'm a Computer Science student in my 3rd year, a day without a monitor is a day I do no work.

    They have a reasonable time in which to offer a solution, you wouldn't get a refund if it was a few days late.

    Most people would consider anything upto 28 days to offer a remedy reasonable.

    I'm sure you the university will have computers you can use?
  • Well they have already offered the solution, but their delivery is late. I honestly don't mind if its one/two days late but I'm just preparing worst case scenario's.

    @arcon5: for some of my work yes I can, but some of it uses specialist software that are used by roughly 15 people in the full university, therefore the adminstrator's simply don't bother putting it on lab computers.

  • At the end of the day, if they choose to repair/replace then it should be done 'within a reasonable time period' and should not 'cause significant inconvenience to the buyer' (quoted directly from section 48B(2) of the Sale of Goods Act 1979.

    Unfortunately each case is judged on its merits and in most cases 2 or 3 weeks may well be considered reasonable. If you need a better response then unfortunately a warranty that offers a 24/48 hour response swap-out may have been a more appropriate solution.

    In the meantime you will have to see if they can provide a resolution in that 'reasonable time period'
