Late Wages!

Hi All!

I'm new to the MSE Forums but I really need your advice! Brace yourselves this a long one :)

I currently work for a very small recruitment company that's been going since February 2010 as far as I am aware. At the moment I am the only employee (there was two of us but my colleague walked out a few weeks ago) This however will soon be changing as we have taken on a new employee. We currently have a handful of clients, one or two very big clients in fact and the future does look promising....so that is the background covered.

My problem is for the second month in a row my wages will be paid late. Up until now I have received my wages on the last day of the month rather than the last Friday of the month as stated in my contract which hasn't caused any real issues, just a little niggle which soon goes away when I see the money in my account.

My employer has basically told me he cannot afford to pay my wages this month due to overpayment to two of our temporary workers (This was due to his negligence entering the time sheets) he has asked his bank for an overdraft so that he can pay me but he is still waiting to hear if the bank will authorise the overdraft. So I'm left wondering if and when I will get paid.

From what I understand I could write a letter of grievance and demand payment within 7 days but I know my employer cannot afford to pay me so I cannot see this resolving the problem. It seems my employer hasn't made provisions for staff wages. He himself admitted to me all he does in the office his respond to emails and answer phone calls, he already has plans of expanding and opening offices in other locations despite not being able to run this one.

So after that long essay, is there anything I can do about the situation with my wages? and what is the best way to tell your boss he does not have a clue about business operations?!

    I think that you should send the letter of grievance as proof of requesting your wages and look for another job. If your boss cannot afford to pay you then is a very bad decision for you to carry on working there.

    you will need to get formal with him somehow, he needs to get a grip on cashflow. And if he hasnt got cash you need to know sooner rather than later so you can get job hunting not working for free.

    It's time to man up and stop being nice! I think I have been avoiding the fact that the business will never succeed when the person in charge does not know what they are doing.

    if the business was doing well, the bank would easily cover one persons wages for a month due to a cashflow hiccup.
    Debt free 4th April 2007.
    New house. Bigger mortgage. MFWB after I have my buffer cash in place.
  • It doesnt directly help but I thought that Employment Agencies had to hold financial reserves to pay wages of all assigned workers for 2 months? Or is that only employment businesses?

    Might be a sign again that money isn't there when it should be?

    And he's taken on someone else to work there too?! How will he pay that person?

  • @lizzywig that is exactly what I am thinking!

    Time I had a conversation with him. If he doesn't sort his finances out I'll only be having the same problem again month after month.

    The problem is I see him spending money on things he doesn't need for the office but I don't know if it is my place to tell him that. I guess now I have my wages as a good excuse to bring it up in conversation.

    My suggestion rather than rocking the boat as such would be to talk to him about the pay as opposed to writing him a letter, at least if you go on the search for another job and get one before causing to much of a rift then hopefully you will not suffer a great deal of hardship due to no income.

    If it were me and I thought that he was wasting money on things that are simply not needed and was not getting paid then I would bring it up in a conversation and if you have any other ideas on saving money then mention these as well after all until you source other work you need to keep him sweet in order to get what you are owed, and he may even listen to you and turn things around and then you can decide wether to stick with the firm or not.
