Nan in trouble (as a guarantor)

Sorry about your situation and can't offer much advice about this but from what you have posted it looks like your nan may be missing out on Pension Credit - everyone of her age should have at least £137.35 per week coming in if they don't have much in savings - may be worth contacting your local CAB/Welfare Rights Team for a benefit check?
Hope everything gets sorted soon.0 -
What Nan must not do is to default on her own rent just to make these weekly payments. Your Nan must not put her own security of tenure at risk. £30 a week for a £500 debt means that the interest-rate must be utterly usurous. I think she should cease making any payments at all. If the family cannot cover this small debt then let the blighters take her to court. With your Nan being on a State pension the courts will in all likelihood award them something affordable. They can't take from you what you do not have.0

I don't have knowledge of the law etc, but I think the best thing to do is to ensure that nan's back-rent is paid in full - the roof over her head should be the priority.
I'd then get in touch with the loan company, explain the situation and take it from there.
It's a despicable thing of your Aunty to do, and she should be totally and utterly ashamed of doing this.0 -
stop her paying...you can not get blood from a stoneIt is nice to see the value of your house going up'' Why ?
Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
If you are planning to upsize the new house will cost more.
If you are planning to downsize your new house will cost more than it should
If you are trying to buy your first house its almost impossible.0 -
I would explore the possibility that this was deception, the aunt had no intention of paying the money and duped the elderly lady in to signing paper work she did not understand.
I would think a call to the police may land some sympathetic ears .
If its deemed she was a victim of crime, she owes nothing.Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -
If she is coming into money can't you just blow her up to FLM ? Nan is guarantor but Aunt owes the money. Financial abuse social services safeguarding referral?0

Your nan may be classed as a vulnerable adult (depending on her overall circumstances) and I think that you should also speak with the local authority/council's social work team about 'Safe Guarding'. Your aunt may then be investigated to determine whether she is considered to have deliberately taken advantage of your nan. Even if not, she may at least be ordered (legally) into making repayments so as not to deprive your nan of a basic living standard.Lizzieb151 wrote: »Hi there, Nan is receiving a state pension £102 pw and lives in sheltered accomodation provided by the local authority and as I said no assets whatsoever. Agree with all of the above. The loan company will take the easiest course of action, which currently is getting the payments from nan. She has to stop paying and force them to go after your auntie for the payment. I really hope that by now some members of your family have spoken to the auntie and told her exactly what they think of her!!DMP Mutual Support Thread member 244
