HELP PLEASE - Is this legal?
In spite of having a DMP Loan Repayment in place for the last 2 and 1/2 years, Lloyds keep trying to take the original Loan Repayment Amount. It is Returned to Drawer unpaid and they then tack on £35.00 charge plus interest. This has been going on for several months. Is there anything I can do to stop this once and for all?
They lie and claim they have not received the DMP payments, when I have their own statements showing the payments have been made. They also harass me with phone calls, and recently threatened court action and Bailiffs etc., I have written a formal letter of complaint to Head Office, which they forwarded on, and I am now waiting for an answer from their Collections Department.
PLEASE, can someone answer this question.

If you haven't already, start making a claim for all the charges to be refunded.
To obtain a 'once an for all solution' you may need to get some sort of court ruling against Lloyds to honour the DMP which presumably they agreed to?
May be worth speaking to the organisation that set up your dmp or CCCS or citizens advice.
R.Smile , it makes people wonder what you have been up to.0 -
The payments are made via CCCS. They have a problem too in that any Financial Statement they send to Lloyds on my behalf does not go Recorded Delivery, due to the fact CCCS is a charity. Lloyds then claim they haven't received them.
After my last 'Assessment of Expenditure' a Financial Statement was sent by CCCS to Lloyds, which they claimed had not been received. At Lloyds 'request' in some of their harassment calls, a further three copies were sent over the period of a month.
I know I am not the only person subjected to their lying tactics. Most of my phone calls are to CCCS in trying to sort things out, but I believe they too are hamstrung by Lloyds rotten tactics, and Lloyds absolutely refuse to talk to CCCS although they have my client number and my authorisation to do so.0
