HELP!! Have i been treated right?

I bought a Canon MP360 All in one printer , and it was developed a fault paper will not feed through

I bought the printer on august 12th 04, took it back to PC World last night , waited in the huge que with angry customers got to speak to someone and was told basically its not our problem you need to ring this number! Canon helpline select option 3

He said they can only swap or give refund within 24days thats "company policy".

Is this employee taking absolute nonsense or do i really need to ring Canon , get it sent away and all that trouble

    Hi

I would have thought you were entitled to a refund if the product is faulty,

Just to let you know tho, PC world were actually cancelling orders a few weeks ago because the mp360's were faulty and sending them back to the manufacturer.

Call into the CAB if you can and get some info on returns/refunds policy on faulty goods, dont give up, if you want a refund stick to your guns.

I actually have one myself from there, and they cancelled my order due to the fault and had to wait for new supplies which i now have and fingers crossed alls been fine with it

    Good luck x

p.s, I believe when you purchase a product, your contract is with that company not the manufacturer so its down to them to deal with it, i could be wrong but i really think that is the case.

I thought you were entitled to a refund up to 12 months if a product developed a fault within that period, the company you purchased from is liable,

    HTH :)

It is clearly not of merchantable quality if it only lasted that long. The onus is on them, not the manufacturer. Have a look at the trading standards website for your rights.

i had a similar problem with pcworld...

i had a hp psc2115, which developed a fault with the paper feed.

ended up contacting hp, who said no problem, we will arrange a replacement.... which they did....

i think pcworld gaurantee is only for so long (ie 1 month), unless it is specifically a product made for them. where it is made by someone else ie canon/hp then after the initial purchase gaurantee , then all faults should be referred back to the manufacturer's customer service....
smile --- it makes people wonder what you are up to.... ;)

It is up the retailer to sort out faulty goods, not the manufacturer, SEE HERE
The "24 day rule" might be company policy, but does not outweigh the law
    (SALE OF GOODS ACT)

    Also SEE HERE

Have you tried ringing on the freephone number?
It night be worth going in to PC World with the info and ask to speak to the manager, don`t let him fob you off with the manufacturer, you will have the info with you. Tell him you will cintact Trading Standards and if neccessary take it to the small claims court under the SAle of Goods Act (not suitable for purpose)

  • 100% the retailers problem - they are allowed to use the sale of goods act also to in turn claim from Canon - Id get dwn there and point out sections 13 & 14 to the manager!! Also mention the implied terms act - which is that it should be fit for the purpose - if they dont help you - take them to Court!!!
:D I understand ALOT more than I care to let on :D
