    Hi

    I e-mailed on the 12th January, received an e-mail acknowledgement the next day stating that they would respond within 21 working days.

    Then, like many, it seems, I received a holding letter at the end of January which didn't give an actual timescale.

    I rang to check the position on 17 February and was advised that they have eight weeks to respond and that my case had not yet been dealt with.

    My 8 weeks therefore expires next Thursday.

    If I was you I'd be giving them a call tomorrow given that the 8 weeks is all but up.

    happy bunny - I think this has happened as I also had a credit card with cahoot (my finances are debt hell) along with others but I dont think I probably kept any paperwork - more than likely read it, didnt think there was anything I could do about it and then binned it...? I do still have the credit card accounts - theyve probably all done it to me! When did the whole 'opt out' option start occuring _ I could either try complaining with no details or I could ring them and see if they have the rate rises on file - dates etc. Ill try anything as situation is dire...

    Not sure when the opt out came in. Will take a look at the weekend if I get chance. I would suggest you google or create a new thread to ask.


    If you send them a subject access request, it should have the relevant info and cost you a tenner. you should also get a copy of you loan and creit card agreements which will also have the initial rates. They have 40 days to respond. Shall we start a new thread for this? Or pm me and I'll send you more info on my claims at the weekend.

    08/01/12 ack e-mail
    31/01/12 'looking into it' letter

    ....still waiting for any more response

    Your eight weeks is up on Sunday (so say Monday).

    That's when the letter has to be sent, so I think that a phone call would be reasonable if you want to check the position.

    never had a flexiable loan but did have a flexiable credit card which i still have and the apr has only gone up but i guess you cant claim for credit card?

  • hope all goes well for all waiting i was lucky enough to get in early and had it all sorted in a few weeks....

    i have however had a separate complaint in with them since sept/oct time.... initially I got a letter every 4 weeks advising that was taking longer than expected to resolve and they would be in contact either with a resolution or a futher letter giving another 4 weeks, my last letter was 15th Dec and have heard nothing since have emailed a few times, previously emails were responded to within 48 hrs with apology etc now am getting no response have requested twice now they advise if is still under investigation or not so I can take to the FOS and request they investigate.....

    they definitely taking a lot lot longer to respond or resolve any issues now, not just with refunding the interest as that has been resolved for me.... this is an entirely different issue.... so hang on in there and good luck all still waiting for a response..... from what I can see the longer wait and response time is extending to other unrelated complaints too xxx

    I'd just pick up the phone and say that you're going to the Ombudsman if it's not resolved in seven days.

    They have eight weeks to resolve the situation and then you can complain, regardless. Obviously you shouldn't look to be unreasonable, but it's more than two months since your last letter, so no-one could accuse you of being impatient.

    No resolution letter here, but I'm now pretty sure that this is going to run and run.
  • I know, your right cell, in the 1st email since getting no response, I had said out of respect I am advising you now of my intention to take this matter to the FOS I do however feel its only fair to allow you to advise of your current position as to whether the issue is still under investigation or you have reached a resolution, please advise..... I heard nothing and since emailed attaching that and all previous correspondence again asking for a response.

    I should call however they are such a pain when u call having to explain explain and explain only to be told someone will call and they dont lol stress i really dont need or want ..... think i may drop the ceo an email with all info see if that gets any response..... again tho fingers crossed for all waiting for a response no news is (hopefully) good news ;) xx

    Can I just ask, are you complaining about how they calculated your refund ?
    They calculated mine from 14 % (original rate was 6.9%) and they wouldn't give me a detailed breakdown so I went to FOS end Dec and they wrote to me 8th Feb saying they have written to Santander for their side of the story.
    I think with more people going the FOS route it has spooked them into stalling tactics.
    I will post when I hear from FOS and/or Santander.
