Dead right Denza. I'm having great dificulty understanding how there can be 2 separate rulings by the same organization on the same complaint.
The FOS have already said they are looking into these claims as one, so past judgements have surely to come into play.0 -
Further to my previous posts, I sent a complaint email to ceo@santander.co.uk only to have it deleted without being read, so not impressed with the response so far!
Have just been told by member of staff at Santander that they have received an email about this thread an Money saving expert and have been told that the correct email address to forward complaints to is as follows:-
complaints.chairmancb@santander.co.uk

You may be right, in the end, but that's the outcome that Santander obviously want.
There are a number of questions to answer from both Santander & the FOS if this is indeed the standard response, not the least of which is that apparently inconsistent handling of earlier complaints.0 -
Hi,
I received the standard rejection letter back from Santander today....do you think it's worth still sending a further complaint onto the FOS as I would still like to know how they can give out 'goodwill' gestures for a certain number of months and then all of a sudden change their minds??
Think i'll still give it a shot....all they can do is reject!!
Anyone else have any other updates on this issue?

I'm personally still waiting for the FOS to assign someone to my case. I also have an outstanding PPI claim with the FOS and they have suggested it will be 6 months before anyone even looks at that!0 -
Hi All,
I've written to Santander, then to the FOS, and am waiting for FOS to actually allocate me an adjudicator. I've also sent off my CCA request, and my SAR request - not surprisingly, no sign of either, two weeks later.
In the meantime, I've also written to the Unfair Contracts team at the FSA; reading their website, they base their decision on whether to act partly upon how many people may be affected - may I suggest that all the people watching this board write / email the unfair contracts team ([EMAIL="unfair.terms@fsa.gov.uk"]unfair.terms@fsa.gov.uk[/EMAIL]) / Unfair Contract Terms Team, Financial Services Authority, 25 The North Colonnade, Canary Wharf, London, E14 5HS, mentioning clause 13 (the one which gives Santander carte blanche to raise the rates). Might be worth contacting the OFT too; I'll do that this afternoon.
Does anyone know if clause 13 has been challenged in the courts yet?
To anyone considering not bothering to complain to Santander; each complaint to the FOS costs Santander £500, so if the amount that they have "acquired" from you is below that, they may settle; if its more, then at least you can cost them some of the money that they've extracted from us.

Hi i'm new here but i also made a complaint to Santander but received a rejection letter and photocopies of the terms and conditions. However i noticed that the terms and conditions are from June 2006 and when i took out my flexi loan in september 2001 i actually didnt receive a copy of the terms and conditions from cahoot with the credit agreement so i actually printed them out from the website at the time and don't know why i did it but i kept them all this time. Now dont know whether its important but the terms are slightly different and instead of
13. a To maintain the competitiveness of our business as a whole taking into account actual or expected changes in market conditions
b To reflect actual or expected changes in money market interest rates
etc
etc
it has a series of bullet points stating this
The changes will be made for one or more of the following reasons:- to provide for the introduction of new or improved systems, methods of operation, services or facilities
- to reflect an expected change in market conditions, general banking practice or the overall cost of providing our service to our customers
- to reflect a change or improvement in the facilities or services we provide
- to conform with or anticipate any changes in the law, codes of practice or recommendations of the Financial Services Authority or other regulatory body
- to ensure that our business is run prudently
- to take account of a ruling by a court, ombudsman, regulator or similar body
- to make the terms and conditions clearer or more favourable to you
- to rectify any mistake that might be discovered in due course
- or
- for any other valid reason
Anyway i'm going to complete a form to the FOS about this and see what happens0 -

Hi,
This is in hold until such time as the FOS route is closed however everything is pretty much in place to get the ball rolling.
Should the FOS enquiry revert to the FSA and/or OFT however this would then be the preferred route.
i.e. litigation is the last resort
