I have filled out the BR form online. Advice

I have completed the form to the best of my ability, and now feel "Oh well here goes, just do it"

But all the doubts & fears are coming in now, so some questions.

I have a letter from my Dr confirming I am Bi-polar and that this has contributed to my situation. Is this a good thing?

I noted some people say they have to provide, bank statements, cc statements etc, I have got all my payslips.

I only have very recent ones, because I tend to have a habit of destroying documents (Bi-polat related). Do they need them because they want to know how I am spent the money?

I have a basic account in my ownname with 3.99 in it. My Nationwide account has been frozen by the nationwide. I have my sick pay paid into my husbands account, so that I cannot go Bi-polar with it!!! Does the court need to know that?

I had to say what date the Debts occurred, these occurred over about 18months/ 2 yrs or so but have been mounting due to interest, is it correct to do the date as the date of completing the form?

I noted too that judges ask if you have been advised re bankruptcy, I was with CCCS, do I have to provide some kind of proof?

I did talk the CCCs, and they started helping me, but they said if I got any more debts after they started to help me, they would not help any more. I spoke to them in August, and then had a relapse and icreased my debt on the CC card I was trying not to use. (i did use it for bills not playing) I was too scared to tell them so have not had any recent advice. Should I contact them again?

Do I need or have to have a legal Representitve?

I am getting treatment now, but it is very hard and difficult.
I am trying to go back to work, I am only doing a few hours a week to ease me in. Hopefully it will be ssuccessful. I will eventually be part time, Half my original pay when I got my credit. I have been off sick for a year.

My debts are about £36000.00, I need to get this behind me so that I can try to get my condition under control or better. I hope I have made my self clear. I hope you kind people can give some sage advice and answers.

    Hi Elleyce,

    Just a brief summary of the questions you posed:

    1. A letter from your doctor would certainly explain what had led to the debts being incurred.
    2. It’s not a problem if you don’t have bank and credit card statement; the O.R can get copies.
    3. The court doesn’t need to know but the O.R will want a list of all your bank accounts and credit cards.
    4. The O.R will want to know what income you receive and where it’s paid
    5. The date is just an estimate of when the debts started to mount, so over the previous 18months would be an acceptable response.
    6. Might be advisable to take any correspondence from CCCS with you to confirm that you have taken professional advice. It might also be worth updating them so see what they advise.
    7. You don’t really need a legal representative, some people have used Insolvency Practitioners to help with forms and the court appointment but it’s not really necessary and it will be an additional expense.

    If there's anything I've missed, post again and I'll have a look when I finish work.

    Hi Elleyce

    You may find that they ask where your wages are being paid - purely because they know your account will be frozen so will want to make sure that you can access your money.

    I had my family benefit and CTC changed to my H's account - the court clerk asked me if I had a way to access my benefits as this is the only money I receive a month and I told her that I got them paid into my H's account - they were happy with that.

    I basically have no paperwork relating to my debts - I did online banking so all my statements were online, and when I was going through my ostrich phase (burying my head trying to ignore it) - i shredded pretty much everything. Explained to the OR and that was fine, they can get copies of what they need off the creditors.

    The only paperwork you'll need to take to court is the bankrupty application (although you are doing it online you will need to print off and sign).

    You dont need to prove you've had legal advice - they just ask and accept what you tell them.

    As I didn't have any of the paperwork I had to guess at the dates I got my credit - again, I explained this to the OR and they noted it down.

    Re: the bank account with 3.99 there is a section on the form where you have to put all your bank account so just put it in there.

    Hope this helps.

    Have you phoned the court for a date yet? I'd do that ASAP (if you have the fee) as I had to wait just over a month after phoning for my appointment.

    alidadas, don't I physically have to take the form in before they give me a date?

    I have printed it off and everything, and someone is going to lend/ give me the money to do it, so have I already started the ball rolling ? OOOh help!

    Nope just phone up and ask for a date to petition for bankruptcy. Then just turn up on the day, at the time they give you with your form. Thats the only paperwork I took with me and I wasn't asked for anything else but I'm not sure if it differs at each court so it might be worth asking when you call just to be on the safe side.
