Advice needed on removing a default notice

Hi,

I'm currently trying to get a "Default" notice removed from my Credit Report. I am hoping somebody might know of any links to any procedures, or the best way to do this. :confused:

It's from an old mobile phone bill a couple of years ago. I unfortunately had to get an Ombudsman to investigate problems I was having with my provider and massive errors in billing and being cut off etc. Suffice to say I won the toss and they had to apologise for incorrectly billing extortionate amounts of money. They credited my account with the hundreds of pounds they had initially charged me in error and agreed a final balance with me of £96 odd which seemed reasonable.

I never received a final bill from them and at the time was in the middle of a house move. Stupidly I didn't pay it off at the time and never heard anything further. (I had let them know I was moving and gave them my new address at least twice, which I have evidence showing they have on file).

I have recently been in touch after seeing my Credit Report with the Default :eek: (after being turned down for a loan) and asked them to remove it (stating I had never received a final bill, reminder or notice they were going to apply a default). Unfortunately they won't budge and I feel this is hugely unfair given they have never sent a bill or a reminder let alone a notice of default!

Does anybody have any recommended action I could take to persuade them to remove it?? I would be extremely grateful.

P.S. I have requested a copy of their final bill which they claim they sent back in the day, however when it arrived it is nothing more than a screen print and not even on company headed paper. Would I be best just to pay the outstanding balance now or request a true & certified copy??

    One tip:

    You have the right to put a note on your credit file, usually up to 200 words. Avoid this at all costs. Usually this results in companies/creditors having to look at your file personally, as many of the automated checkers will bypass files with user notes on them.

    If all attempts at having the default removed, ie trying the company who put it there, trying the credit reference agency, and you really must put a note on, make it clear, concise and to the point. Don't point blame or put excuses as to why the money wasn't paid. A note on the file should really be the last resort, sometimes it's better to just leave it there and explain to creditors who are not giving you the credit you need because of the default the reason for it being there.

    I got this from a company that combines reports from all three agencies, so trust it's valid.

    I'll leave the note for now and keep building a case using the link that tigtig provided. I think I will keep trying to build on the correspondence I have already started and maybe have to call in another Ombudsman to help clear the matter up!
