Business Legal Question

I'm about to launch a content site with a directory which will be listing some related businesses/services.

My question is: As I'm going to give all potential clients a basic listing free of charge, especially in the early stages while I work on the sites marketing etc..., would I be able to list all the businesses and then maybe contact them by phone/mail afterwards to to try and sell a more prominent lisitng or would I need consent first?

What would be the worst that could happen? They would have to ask me to remove their business from the site first which in turn would mean their loss as my intention is only to promote them!
