I currently work for an old lady who husband
has alzheimer's.
she didn't want the social care workers as they were arriving at different times each day .
so the social pays her money to pay for her own care workers ..
me and another-- both males--.
I get paid for 19 hrs/partner 16 hrs.
the agreement was for both of us is that she only need us for 1hr to wash/dress her Husband as he no longer can look after himself or walk.
before I took the job on we had a discussion on what is expected of me.
she said she only needs me for 1/2 to 1 hour but get paid for 2 hrs regardless whether I work it or not and the call out hours(7days)
she will pay me them whether I get called out or not.
and the agreement was I get those hours to help with my cost of running to and from work other wise I couldn't do the job.
I live 21 miles away.
the problem that I'm having is that she started to take wages off me to pay towards her husband going into respite.(I'm classed as self employed so I pay all my duty's stamps etc and self liabilities insurance in case I hurt myself with lifting)
how it work is that I'm on call 7 days a week for 1 hour each day.
odd occasions I've been called out .
my wage suppose to be £180 a week of which I spend £40 a week on fuel.I'm getting paid £161.50.
she is holding back £19 what for I don't know
the other guy it doesn't affect him at all ,he still get the same regardless.
she is expecting me to look after her husband while she goes food shopping but still she put him in a home(respite)for the day the day before and I don't get paid leave.
and when she goes away for aweek she puts her husband in respite, we dont paid but the social still pay her.
what ever money that don't get paid to me or both of us she uses for her own use.
she even said that she gets more money than she needs from who ever beside getting our wages.
I would have thought that the wages she gets to pay us is not hers to spend.
she has !!!!!!ed the whole thing up. when the audit decide to come and have a look .they'll be wanting to know why and were is the money going if not to us.
by the time expense's come of I dont have enough to pay my stamps let alone house bills.I'm £60 short amonth of what I require to keep my head above water..

So you work an hour a day and get paid for 19 hours a week? £180 a week is a good wage for seven hours work, even allowing for the occasional call out.
Does this lady receive Direct Payments to pay you and the other carer? If she does, then she should have employer's liability insurance and should be paying your tax and NI (if any is payable). The council allow for these in the payments that they put into a Direct payments account each month. They also allow for holiday pay each year, at 28 days pro rata to the hours worked.
How do you know she uses this money for her own use? If it is Direct Payments, then she wil have to account for every penny that she spends. You could repoirt her if you think she is spenfding the money on herself, but be aware that the council may also check your actual hours of work.
Also, it is not her concern that you travel 21 miles to work, nor is the cost of fuel her concern.
If you are working so few hours, can't you get another job to keep your head above water?
However, if you are accepting pay for hours not worked, surely this is fraud? Councils are tightening up on many areas of expense, including Direct Payments.
How do you know that the lady is paying additional amounts for respite? If she needs respite, doesn't this imply that she needs you and the other carer for more hours than you are currently attending to her husband?0 -
This lady has a pesonal allowance and how she spends it is not anyone's business but hers. It is not "to pay for your wages" - it is for her to spend to make her life manageble. You get paid for 19 hours per week but the absolute most you would work is 14 - and that assumes that you work one hour per day which you say you actually work 30 - 60 minutes, and get called out seven times in a week which you say only happens occasionally. When audit decide to come and have a look the question they are likely to be asking is not about the respite care for her husband (which makes her life more manageable and is a valid expense) - it is going to be why she is paying you for nineteen hours when you do not work that many hours.
You are not entitled to paid leave - you are self-employed and get no leave at all.0 -
Self employed, if you don't like it change your terms or get work elsewhere.
Up your hourly rate and/or impliment travel time with expences.
the lady can look for someone else if she does not like yor terms.0 -
