Advice Needed Urgently

Hi all,

i'll try to make this as short as possible! Ex-girlfriend left me with loads of Debts when she left what in March will be three years ago. This was made all the more difficult by the fact that I was studying to me a mental health nurse at the time so as you can imagine money was not in large supply. I have managed to pay off about £7,500 of debts and am just left with a few. I have been stalling them since about march last year when I began work on my dissertation as I just could not work extra shifts and do that as well. Since qualifying it has not been easy to get a job nhs cuts and all that but was finally made permanent in Dec. I wrote to tell my remaining creditors this and all except one replied. This one replied at the start of Dec through another firm saying if i did not pay the full amount immediately they would serve me with a statutory demand under the inslovency act. I replied to them straight away offering payment of the previous amount I was paying last year and explaining my circumstances.

They appear to have taken no notice of this and last thrsday I was served with said papers which means nothing to me. I have nothing to take.... I rent my house I have a car that would not get £2oo for scrap and most of the furniture and stuff in the house belongs to my new wife.

What is this order and what do I have to do, I was expecting if anything a county court order. Any advice or help gratefully recieved.

    hi there, bit out of my league I am afraid. But if you post the question on the bancrupty supporters club thread I am sure Mike St Helens will be able to help.

    I have a nasty feeling that they might be trying to make you bankrupt, but I stress I am not sure.

    Yes, a Statutory demand is the first stage in petitioning for bankruptcy.

    In order to petition for your bankruptcy the creditor has to have given you a chance to repay the debt, they therefore issue a Statutory Demand requesting payment within a certain time period. If they don't get their money they can then petition for your bankruptcy.

    Although they can petition for your bankruptcy once they have issued the Statutory Demand, they may not do so, they could be doing it to frighten you into paying. Don't ignore it on that basis though, I know of a case where the stat demand was issued to frighten someone into paying but the petition got served and the bankruptcy order was made because the person dealing with it was away and someone else just continued the process.

    Until they present a bankruptcy petition to the court, it's just scare tactics.

    It'll cost them over £500 to do it, and they can't be certain of getting that back from you.

    Continue paying what you can afford.

    Can you give details such as how much they are, the APRs, loan or card, minimum payments.

    You could do a full SOA - see southernscousers sticky for first time posters for a template. If you give more details about your situation - the advice will be more useful and relevant.
