We are in the process of re mortgaging to raise extra funds for an extension, my current lender is not doing any re mortgages so we have swapped to ING, the offer came with free legal fees. Mortgage offer all ok, all signed and returned so expected fees to be release end of this week.
Our property is a freehold, the previous owners bought the lease in 1999, we bought the house in 2002. There was never any issues with the deeds or lease. The solicitors are saying there is an issue, I have send the copy of the deeds I have, the previous owners copy and all the receipts to prove the lease was purchased. i have got every piece of paper and receipt relating to the house from when it was built in 1673.
i have gone through all my paperwork from my original solicitor and the only thing I can find is a statement that even though the lease was purchased the terms still need adhering too. Things like garden walls and access for gas and electricity supplies, boundaries and rights of way.
I have sent them copies of everything I have but they still not happy, I really don't understand what else they want. They keep on about deeds, I have copies of deeds!
is this a ploy? In there pack it says all extra work will be charged as extra so is it a way of making extra money?
i need these fees released by end of next week or the builder will start another job and mine won't start till after xmas now.
Can anyone help please?

They haven't given me an exact question. Sorry, after three calls today I really don't know what they want.
That they need to investigate the lease! What lease I keep asking them. they just reply they need more information. On my deeds it says
A. property Register ''Freehold'' then mentions about freehold land shown and subject to rights reserved by the transfer date April 99to the charges register. (date freehold was purchased)
B. Proprietorship Register. Mentions myself and hubby and 'to observe and perform the covenants referred to in the charges register and of indemnity in respect thereof.(No idea!)
C. Charges Register lease dates October 1973 for 99 years. A transfer of the land in this title in april 1999 made between.... and......
So as for their exact question they just keep saying more information about the lease.! Totally confused!0 -

So is this normal protocol from so called free legal?
This is the first time I have been through a re mortgage, thought the process was straight forward.
Are you suggesting i just go back to my original solicitor who dealt with my sale and start the legal side again? Can I do that?0 -

I suspect the issue here, is that something has not been recorded properly, either when the lease was bought, or you bought the property, I don't think this is anything to do with the free legals, I have never have a problem with the free legals, in fact quite the reverse, all the problems I have experienced have been due to clients own solicitors.I am a mortgage adviser.You should note that this site doesn't check my status as a Mortgage Adviser, so you need to take my word for it.
