Hi,
Can anyone help me decipher some legal jargon & clarity on tribunal process? I'm heading to a case management discussion in December and have just been sent an agenda to complete. The claim is for unfair dismissal as a result of incorrect employment status. I'm working through the agenda but just need clarification on what they mean when they ask whether there should be "submissions". It also asks for lists of documents and actual documents in another section so not sure what submissions are. Also there are a few issues from the respondant that need clearing up - they say I resigned & agreed to work on a casual basis (I didn't) and they say the employment start date is 2005 and I know it was 1998. Are these issues for the CMD to resolve or will should I put them as preliminary issues to be decided at a pre-hearing? I think we will need a preliminary hearing to prove the employment status bit prior to the unfair dismissal at tribunal - but not sure when the discussions about the inconsistencies with my claim/their reponse will take place?

Probably need to see the context, but 'submissions' at this stage in the process are usually verbal and/or written representations on a particular issue.
As regards the issues of fact, the Judge will let you know if they see any issues as being appropriate for a PHR - or the resopndents may request a PHR on a particular issue. Your employment status may be a preliminary matter, or it may be central to the whole case - we don't know without knowing the detail of your claim. They would not be appropriate to a CMD which is only concerned with the administration of the case, not the substance of it. If they are not dealt with at a PHR then you would need to include your position on them in your witness statement and provide documentary evidence of your start date and employment status in the bundle (and/or provide witness evidence to do that).0
