Earnings Arrestment.. Money not paid to Creditor
Options
Hi would be grateful for any advice.. Live in Scotland.. Had an earnings arrestment starting in March 2010 for Approx £4000
Moved jobs in January this year and arrestment was restarted in June with new employer.. Was checking last week all my wage slips (from both companies) and there is just under £1000 from my previous employer that has not been paid to the creditor.. Phoned the creditor and they confirmed this
My wage arrestment should have stopped 3 weeks ago.. I cant afford a solicitor and dont qualify for legal aid

Am replying to this to try and get some advice.. If the arrestment continues I will not be able to afford my rent.. My hubby lost his job earlier this year
Is there anywhere I can get legal advice free.. Have contacted my previous employers.. By phone 3 times and email.. No reply
They were very angry when I left.. last payment to creditor was early nov 2010.. I had a further £600 arrested from my wages between the end of November and December 2010.. Have searched online for hours but cant find any reference to what I should do
Many thanks for any advice x0 -
Do you work for a large employer now? Sometimes they have an employee line that gives legal advice.
Failing that I'd send a letter recorded delivery to the HR Manager asking for help. I might even send a repeat if I didnt get a proper answer. After that I think I would either 'invest' in a Solicitors letter or consider taking them to the small claims court. I think the max might only be 750 quid in small claims but it would be closer than where you are now!
Im not a legal boffin so def worth getting some professional advice.Light Bulb Moment - 11th Nov 2004 - Debt Free Day - 25th Mar 2011 :j0 -
The arrestment was for a car I bought.. cost £5000.. Hubby put it on as a taxi.. It broke down after 2 years.. (Oh all payments were up to date.. 4,800).. Told hubby to pay £30 to have it towed.. Being a taxi driver.. He said his brother would tow it for free.. In the meantime it was stolen.. Insurance paid over £2000 to advantage finance.. Total paid £6,800.. I included Gap insurance and sent them all the documents.. They said the hadn't received them.. I stupidly thought having a full time job and 5 kids.. whatever.. Result arrestment for 4,200.. total 11,0000

Thank you very much for your reply.. Really appreciate it.. But don't work for a large employer.. I'm a nurse and always had RCN cover.. But since hubby was stopped from working earlier through illness had to cancel.. I have made my present employer aware of what has happened.. They are very sympathetic but unable to provide legal cover.. All businesses are struggling0

You don't have legal assistance included with your home insurance policy by any chance?0
