FLM lied during investigation

    What a horrible place to work, if I were you I would be looking for another job and complaining to head office (you mentioned it is a shop so I assume it is a chain) about the shoddy way this was handled. I would also see about getting a copy of whatever sick day records HR keep in case they get falsified later on, assuming you are actually allowed to see them (at my work our sick/ holiday records are all online so we can look at them whenever we like).

    I have never heard of managers making 'official home visits' and can't imagine a situation where an employer would allow a male member of staff to go and visit a sick female (I assume) in her home- surely this would open them up to a world of trouble if the sick member of staff accused them of something! Why on earth would a shop manager need to make a home visit anyway? It seems so ridiculous- is there anything about 'official home visits' in your employee handbook? This is all so fishy and I don't blame you for being angry, I would be too.

    Pupnik, is the OP female ? I have had home visits from my manager when i was off sick for 4 months, it's part of the companies procedures.
    I agree with the other posters, either look for another job or keep your head down and get on with this one, you can't change whats happened, personally i think if you push this issue, you'll make it worse for yourself.

    well then i would either speak to the union or find a better work place in all honesty

    Y should they have to find a better work place? The person bullying them should be TOLD to leave!

    The OP has said the bullying is no longer an issue. It happened a year ago but they're wanting to bring it all up again.

    regards the whole bullying thing that is no longer an issue, the issue is untruths were allowed to taint the investigation, & my reputation.

    I'm still not getting it...sorry! The guy gave his side of the story, you gave yours. Your complaint was upheld. Whatever he said did not persuade anyone that his behaviour towards you was correct and so they found in your favour (and in my opinion, could be wrong, the things he said probably didn't do him any favours in trying to convince the investigator that he was behaving in an appropriate manner). People aren't stupid, my bully was described by the judge as 'larger in stature, older, more self assured and combative' (PMSL for the most eloquent way to insult someone) He saw right through her despite her insane bumblings about my 'affair' with the Head Teacher...which she wholly believed!

    Who is going to see those investigation notes? How is it ruining your reputation? Why drag up some bad eggs mad ramblings during an investigation for something which was found in your favour and is over and done with? Seriously, why is this bothering you so much? <---- see I'm just not getting it....
  • I only got to see the investigation notes as another FLM spoke to me, 2 months ago, he said that he he read them and could not believe how it was handled, he had never known anyone get away with what had happened, he spoke to the guy who did the investigation & asked what had happened & his reply was, it was taken out of his hands. So other people have had access to the notes, I brought this up with HR & of course they claim this is not possible. I don't work in a shop, when I say shop floor I mean factory floor, & head office is based at my location.

    To me Zero means Zero, not its ok to do what ever you want to staff in and out of work just as long as your mates with management as we have your back and we all stick together.

    I love my hours, pay is ok & I have a good relationship with 99% of the work force...they would love it if I left, why should I, I have worked they very happily for over 10 years.
  • Get out of there, find somewhere else to work, complain to union representatives & try and get something out of leaving them. Sounds horrid though, best of luck.

    And therein lies the actual issue. Nobody who was not directly involved in the process of the investigation / grievance / disciplinary (and that includes you) should ahve seen witness statements or notes of meetings/ interviews. Nobody should share such documents with somebody else, including you. And any manager should know better than to criticise the judgement of a a grievance and / or disciplinary panel to anyone and especially not to one of the parties - especially if they had no involvement in the matter. The actions this manager has taken would appear to be within scope for gross misconduct should be employer choose to consdier it such. The confidetiality of everyone involved should be observed, and no matter what their personal opinion is they should not be expressing it to employees. If, as a manager, they believe that the matter is not at an end, because, for exmaple, the bullying is ongoing and they know this, then the appropriate thing to do is to take action about it - not to gossip.

    I see. So FLM 1 bullied you and you took out a grievance. FLM 2 has seen the notes to this and stirred up a hornets nest by talking about it with you.

    So your choices are:

    1) Whip the hornets into a frenzy by raising a grievance and getting FLM 2 into serious trouble (as SarlE points out, they should not a) have seen the notes or b) talked about them)

    2) Forget about it and carry on enjoying your job

    I know what I'd do.

    Gossip is horrid. People lying is horrid. I know, I've been there so I'm not trying to be unsympathetic, but seriously FLM 1 sounds like a prize wonker and FLM 2 isn't far off either. Don't join them in the wonker stakes :)
