Requesting last wage slip and P45

Hi everyone

I just need some advice please.

My last day at my job was 6 August 2011. I received my last pay before the next payroll, it was paid a couple of weeks after. I was entitled to my holiday pay. The money came into my account but I am not 100% sure that it is correct.

Since leaving there has been 2 payroll runs. I have not received my last wage slip or even my P45. I have written to both the payroll and the store where I used to work advising them that I have sent letters to the both of them via recorded delivery and request that they send to me my last wage slip and P45 within ten days of my letter.

I am yet to receive anything. I am thinking of sending further requests to them via recorded delivery for them to send to me my wage slip and P45 or write to me to explain to me if they are unable to send them.

I'm just wondering do they legally have to send them to me. I guess I can argue that my pay is wrong.

Thanks in advance.

Edit: I don't need the P45 for tax code, as it wasn't my main job but I need the wage slip and P45 for my records.

  • Yes, you are entitled to them by law.
    Quote from HMRC website:
Your employer should automatically give you a P45 when you stop working for them. If not, ask for it - you're entitled to it by law.
  • I can totally empathise with you, as i'm in the same boat myself. Its been 6 weeks since i left my previous employment and still have not recieved my p45. I keep getting fobbed off everytime i ring or call in.

I've had a look on the Revenue and Customs website and by the looks of things they do legally have to send you one, but theres no time limit.

    Hope you get it sorted!

Certainly for a payslip it is required to be issued before or at the time the payment is made.

I was unclear from the OP's post whether any actual payment had been made since the one covered by the last payslip received.

A P45 can only be sent out once though. If they tell you it has been sent and must of been lost in the post then they cannot send a copy, it's not allowed.

We usually send copy payslips free of charge but I have known of companies in the past charging for copies.

EDIT: Have you checked they even have your correct address?

I left just after receivng my wage slip for the previous 4 weeks. A couple of weeks after I left a payment was made into my account. It's seems correct, what I expected but I can't be sure. Either way I want my wage slip for my records. Like I said there has been at least 2 payroll runs since I left.

Yes they have my correct address, I even advised them of my address in my letter.

I really don't know what else I can do apart from writing letters. The funny thing is it's a retail store where "every little helps". I have read on other forums that leavers have had a tough time getting their P45 and wage slips to them. The store where I worked is a walking distance from where I live. I guess I can go there and ask but I like to keep things official and have a paper trail.

    Any other advice is appreicated.

    Thanks
