HFC Bank

Hi, I'm after some advice please. I'm working tonight so I'm just quickly posting the detaisl:
We have a DMP with CCCS set up in 2006 that has been going very well with only one or two little hiccups along the well.

One of those appears to have raised its head.
We took out a 'loan' with HFC via APOLLO 2000 in Oct '05 for £269.99.
The payments were to be £10.89 per month for 43 months.
We got into difficulty in sept '06 and the DMP started in Jan '07.

Upto this time we had not a missed a payment and had paid £67.34 (£10.89 x 6 and £2 whilst the DMP was set up).
We have paid ever since.
ie £270 by 53 payments. Plus the above £67.34 =£337.34 in TOTAL.

In May I believed the final payment to this debt had been paid as we had NEVER heard from HFC Bank regarding this account.

I few weeks ago we started calls from a call centre in India regarding this account stating we owed £293.12.
I wrote to HFC to ask what was going on and to stop the harassing calls. To their credit the calls did stop.
I eventually got a reply with a UK number which I called and asked for a statement.
When the statement eventually came to my surprise they have added the following charges.
Oct '06 - £15 admin fee
Nov '06 - £50 default fee
Dec '06- Jan '08 £15 admin fee EVERY MONTH.

This adds up to £260
We have had NO notification of these fees and no annual statements.

Today I received a letter off 'debt litigation and recovery services' acting on behalf of HFC. I have called them and advised I'm in dispute with HFC regarding the amount owed. DLRS were polite but unhelpful. They stated if I paid £238 the account could be settled.

I've yet to contact HFC about the charges.

Any advice on what I should do please? (Our home is mortgaged and we have one CCJ ((another story!!) )

    Have they been included in your DMP? If so, contact CCCS who should be able to help you dispute the charges. Failing that you'll need to argue the case with HFC yourself, but it's likely to be in their t&c's that they will charge you.

  • Itwas in the DMP but as I said that concluded with this debt in May.

    Ihave no idea what the T&C's say. How do I get them to check?
    I've heard something about CCA1974 and sending a £1???

    The CCA request will get you the credit report, not the t&c's. I would approach CCCS for advice and HFC may have agreed to freeze all charges with them and if so CCCS may be able to help dispute.
