Hi, i have an item from bayv that i can no longer afford, im really nervous of them coming out as i have heard so many horror stories about them, does anyone know what is the best way forward in this situation ie will they demand the item back? Do i give them it back there and then? i have paid over half the money owed for the item but with my financial situation i just cannot afford to pay it any more, any help would be appreciated?

    What was the item? How much did it cost? how much is owed now?

    Have you got the agreement you signed up to? Does it say the item can be handed back after being half way through - I think a lot of these companies won't take a household item back, or if they do the second hand value will be so negligible that you will still owe pretty much the same amount as you do before.

    Have you tried speaking to them to see if you can reduce your payments? Have you done a detailed income & expenditure to see if people can spot areas you can make other savings/ get things cheaper etc so you can carry on with this loan.
    Do you have any unsecured credit you are also repaying? If so and assuming this is secured lending then this should take priority over unsecured credit repayments.

    Op, I strongly suggest that you speak to NDL or CCCS about this.

    ideally, if this is an item you need as opposed to something you would like, you need to check out www.freegle.co.uk or freecycle for a replacment.

    They are under no obligation to take the item back and let you off all the other payments but may be encouraged to do so it if you involve a debt charity (the others being CAP and CAB).

  • Surely they're breaking some rules about credit products as if you view a product nowhere does it show total repayment amount or a representative APR?

    It also says the following

    You have the right to end this agreement. to so, you should write to the person you make your payments to. They will then be entitled to the return of the goods and to half the total amount payable under this agreement, that is £1168.44 if you have already paid at least this amount plus any overdue instalments and have taken reasonable care of the goods you will not have to pay any more

    The agreement was taken out in the second week of April 2010
