I got thinking about reclaiming bank charges and wondered if.......

If banks are being challenged on a legal basis - not one defined by FSA - then surely people can reclaim/challenge any admin costs that are forced upon them and cannot be justified.
I can't think of many examples, but such things as admin fees for balliffs etc.
Can anyone verify whether this assumption may be right? If so, maybe we could put our heads together on where this may apply?

In theory yes, however the line been an “unfair term in contract” or an unreasonable charge under S.15 of the sale of goods act, and a charge that is fair and reasonable is sometimes very thin.
However with the bank charges scenario it is quite obvious to all that an electronic decision does not cost the bank upwards of £35 a time, and they know there is no way they could defend this fee in court, hence the current level of claims being settled out of court:rolleyes: It’s hard enough remembering my opinions - without remembering my reasons for them :rolleyes:0
