    Thanks everyone for all your input, I am going to speak to a solicitor tomorrow or Monday (meeting with new employers Tuesday) hopefully they will be able tell us if going to et will be a waste of our time and money or not. Thanks again. L

    Good luck. Out of personal experience, I know how hard ETs can be whilst pregnant. I had a high risk pregnancy and this was explained to the other side and the Judge, but they still pushed for a tribunal date! In the end, I was in NICU with my premature baby on the day I should have been in court and I was negotiating a compromised agreement from my hospital bed (I say negotiating, it was more like 'I don't give a flying fig, I've got to go and milk myself now!). Please look after your wife, I know it's tough when you don't want to be seen as a pushover, but I will always regret pursuing my claim because of what it helped to cause. xx

    I'm very sorry to hear your story, and hope that everything and everyone was ok in the end.
    I think your right that my priority has got to be my family, maybe I need to put my personal need for justice aside! And let karma take over!

    Well, I nearly copped it, but takes more than haemorrhaging to knock me off and I'm pleased to say that I have a rather noisy but beautiful one year old now :) She was a poorly wee thing and a tiny 3lb 15oz when I finally got her home, but she's doing incredibly well. She has scarring on the left side of her brain but this may mean something or nothing (praying for the latter!) only time will tell. I totally believe in karma :D I think it's definitely worth having the meeting and seeing what they say. From there, I think it'd be a good idea for you to take lead if you decide to pursue things. Just take care and tread gently xx

    I think most everyone who has ever posted here for more than a month will know that I hate discrimination of any kind. So I am going to say again that I do not want to put someone off claiming. But anyone who says that having a lawyer minimises stress has never been through it. I am a barrister. I represent high profile cases and employees only. And not one of my clients hasn't had horrendous stress. I do not know of any client, including those who won, who would do it again. Nobody who has been through it could imagine the stress levels. No matter how experienced a lawyer is, they cannot protect a client from the case. It does not matter how many partners the client may have, how big a family support group they have... it is stressful beyond belief. I would love the OP's OH to get evidence, and I would love them to kick !!!!. I woud prefer that they have a bouncing baby boy or girl.

    OP, be careful that you do not let your quite righteous sense of justice get in the way of that. No matter how much support you give - she will be the claimant. You cannot protect her from that. This must be her decision and hers alone.

    but I have been through it! and it was worth the five figure sum that I got!
    The OP is not stupid - he and his OH will make the right decision and it won't hurt to speak with a solicitor to get an informed opinion instead of a bunch of strangers online guessing.

    Then you are in a significant minority - I have represented 1,000's of cases and not just one.

    I did not suggest that the OP was stupid. I was ensuring that the OP had a balanced opinion and fully appreciates that tribunals are not, as many people think, easy or an open invitation to huge pay outs. Since I suggested initially getting legal advice then I think that I did in fact suggest an informed opinion - but whilst I may be a stranger I am not guessing at what I have said. I have 30+ years and the battle scars to prove it.

    Hi all we are going to seek legal advice on this situation, the new employers have told us that they will put the reason for the removal of the job offer in an email on Monday ready for the meeting on tuesday, I very much doubt that they will put the real reason but we shall see!?

    I think before we make any decision re the et we need to gather all the evidence we can find and present it to a solicitor and see what they think, because this may take a little while, does anyone know if there is a time limit on raising a et? As alot of people have said don't rush in, and we want to be sure before we make any rash decisions.

    Fair enough, but everyone handles stress differently and it depends on their personal circumstances. The money I got will never ever make up for what my daughter had to go through and I thank my lucky stars everyday that we had a good outcome. When your child is born early, and not breathing, money really doesn't matter.

    Good luck! It seems so long since I did any of this now, I think ETs need to be raised no later than 3 months after the incident - I also had to make sure I had been through/started the grievance process by then, although I'm not sure whether that applies in your case. I'm sure someone more knowledgeable can fill in the details for you x
