Although the developer has offered to change it, I would double check that they have that authority - yes, it's fine if there's a convenant with the developer and they are willing to amend it (it needs a written amendment, not just someone saying it's ok - because technically you'll still be in breach then!). However, some covenants are with the original landowner and just because a developer says they'll change it, that holds no weight at all (they may just be doing it to not lose a sale) - if that's the case, 6 months later the landowner could spot it and demand it is re-instated to red!0
