Sorry, I had missed the fact that it is a remortgage. In that case, while the failure to notify the change in circumstances before the remortgage goes through would be fraud, at least if the lender pulls the plug OP would be no worse off than they are today. It is still fraud though, and a breach of the mortgage conditions.I'm a retired employment solicitor.
