Paying back annual leave when leaving a job

So you get 40 days in total, you will have easily had the statutory 28 days.
They can make up just about any rules they like for the other days.0 -

I'm still hopeful (somewhat) that we can reach an amicable settlement because it is relatively little money to them (and I know there is an underspend on my budget anyway!) and I believe it is in their best interest to do so.
I understand that I've received the statutory minimum (and more!) but I still think they should have to adhere to the terms of my contract. After all, my contract included more than the statutory minimum as a sweetener to entice me into the job. If they can later decide they don't need to live up to the promises in the contract and there's no recourse then I wonder what point there is in negotiating contracts at all!Common sense?...There's nothing common about sense!0 -

Hopefully they will see sense and justy cough up for the days since you did the year.
Thing is you did not make sure that the calculations of holiday acrual matched the number of days you though you would get(why would you).
I guess it depends exacly what the contract says about holidays and if stuff writen in the contract can override the normal accrual probably written in handbooks ete that form the full particulars of employment.
Perhaps you can argue that as the fixed term contract was for a year with X days holiday the standard holiday year and accrual methods do not apply.0
