mortgages

my husband died nearly 3 years ago the insurance did not cover the mortgage, my daughter's partner mortgaged the house to cover what was left with myself as joint lender, he has now gone and wants name taken off the deeds leaving my daughter and myself with a mortgage of 82000, my daughter has 2 children 8 and 4 and is on tax credits with a small part time job, i have an army widows pension and a small time job, what do we do to protect our house and the children.

  • Speak to your current lender first and if you can prove that you and your daughter can afford the mortgage without her ex then they will remove him from the title. Should you be unable to show the affordability then I'd suggest you speak to a local broker to see if there are any other suitable lenders.
  • I agree with speaking to your current lender but I'd also suggest an seeking independent advice first ......

    I was looking to get someone removed from my mortgage and my current lender wanted a fee of around £300 and I had to complete a change to mortgage form (which is basically like a whole new application) and there was no guarantee of it being accepted.

    An independent adviser may be able to advise whether it's likely that you'd be accepted before paying the fee / going through the new application (if applicable) with your current lender (which will obviously be recorded on your credit file) - or whether an alternative lender may be better.

    In addition there will be legal costs in removing the other party from the title deeds. A solicitor needs to be involved in this.
