Asda 'take' on employing TCP 'monitor' their car parks!

Apologies if this has been posted in the past as it is a link to a post from 2009, but I just came across this via a Google Search after reply to a thread about Asda and TCP.

The first thing that hits me is the liberal and seemingly deliberate use of the word 'fine' on Asda own website!!! They are admitting they are getting TCP to fine people in their car parks!
Secondly, they are also admitting they are fining people if they use a disable bay without a Blue Badge, but also even if the car has a disabled persons tax disc visible!!!
Finally, they admit that their colleagues do not have the power to fine people but the implication is that TCP do!
I genuinely can't believe that Asda still have this up on their website and seemingly think that because people complain about disabled and parent & child space abuse that using a PPC to 'fine' people is an acceptable and moral way to deal with the problem!!!

asda have pulled burnley out of the sack to justify its nationwide policy.
err. OK then, ASDA: loads of burnley fans descend on yr park and clog it. the prob is localised, so you erect barriers. except you don't. cheaper/easier to 'fine' and donate proceeds (aw, bless) to charity: loads of kudos to be had at the next 'supermarket of the yr' awards ceremony, eh?
wal-mart own you. do they fund their USA operations re charity by a similar method?

I have not seen this page before and I'm actually taken aback by the sheer effrontery of it. If TCP are ever stupid enough to issue proceedings then it should be adduced in evidence to clearly demonstrate that it is their principal's sole intention to penalise its customers and to use it as a deterrent. This page could not make it any clearer that is not in the slightest about seeking "a genuine pre-estimate of their losses" it is a straightforward penalty. Ms Oxspring simply could not have made it any clearer. Besides, why else would you call it a "fine"?
I cannot believe that anyone with half a grain of sense - or perhaps just a modicum of understanding of the law - could possibly think this is acceptable. Furthermore, I would be amazed that anyone either at Asda or in TCP could be under any form of illusion that they could win at court with this as a strategy and if that is indeed the case on what basis do Asda allow TCP to threaten customers with proceedings?My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

On a more positive note - what a marvellous piece of 'defence' evidence this is in the highly unlikely event that TCP risked 'doing court'.

Their insistance on a Blue Badge for disabled bays is (of course) in breach of the Equality Act. Publicly admitting such discrimination is a brave step!

TCP have been invoicing people at my local Asda for parking and then leaving to use the adjacent sports centre. There aren't even any signs up!! Needless to say, I have advised people of the position and pointed them in the direction of further information.0

Another way that TCP fall down is in their signage. If you want to read their full T&Cs you have to ring them up or go online. So if you drive into one of their car parks how are you going to be in possession of the full facts before you decide to leave your car there? I suppose you could stop in the entrance of the car park (blocking other traffic), get out your laptop or phone, and then peruse their T&Cs.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0
