Can't stop shaking..

Following on from my previous threads about selling our house and the RBOS not supplying a redemption figure:
Got home at 5pm to a message from our conveyancer to give her a ring. When I phoned she said still has no figure as the RBOS say the house is in litigation.
I nearly died. Phoned CCCS and couldn't get though. Phoned RBOS and man there said phone Litigations Dept as the house has associated borrowing.
Phoned Litigations Dept and horrible man said the mortgage was in arrears. I said we had never missed a payment. Then he said there was other lending secured on it. I said nothing was secured. He said when we signed the mortgage 5 yrs ago we signed an agreement to say any other borrowing was secured against the house. I said that was silly as when we took out our first loan we didn't even have a house.
I Can't write any more.
I'm too upset.

That is really weird. How come that they are only mentioning this now? Is there some reason why they should be taking the p*** like this. Ie they don't want you to move? What does your mortgage contract say about this? Ie in the fine print.
I think this stinks, tell RBOS that you want to talk to a manager to go through this with you.

Have had a gin and heart has stopped racing.
OK...the man said that when we took out the mortgage, the agreement we signed for the mortgage said that any further borrowing with the RBOS would have a charge on the mortgage.
This seems very iffy to me...its probably in the fine print which we did not read and we should have done. In effect, it means that instead of being able to negotiate a settlement with all our creditors so they all got a pro rata payment from the profits of the house sale, the RBOS wants their money all at once up front.
In the scheme of things, its right for them, but you would have thought that if you were borrowing money from an institution, somebody might have mentioned that all borrowing from them in the future was secured....we should at least have had a lower rate of interest :mad:
This mortgage was arranged by the then manager of the local branch who, at the same time, sold us an income protection policy which it then turned out we could not claim on when my husband was made redundant as it was a Buy to Let mortgage even though I had queried at at the time. I am pursuing this elsewhere.
I know i should fight but I can't do this anymore. If the mortgage settlemnt figure depends on paying this money to the RBOS then it will just have to happen.

You'd have thought that as a "responsible lender" that they would have pointed this out to you - the b"£$^&*s !!!! You shouldn't have had to read through all the pages of small print - why couldn't they just tell you? If we all read the small print then we probably wouldn't be in the mess we are now
Easier said than done, but try and get some sleep (have another Gin or two)!!! In fact, have one from me :beer:

You can probably have them for mis-selling income protection insurance too if it wasn't valid against your particular mortgage!
