Yes -sounds really sneaky and underhand to me, but a quick search around the net would seem to suggest (from what Ive looked at) that the RBOS might be right and they can treat your further borrowing as secured against the property - cant say Id be happy though, so really sorry for you.
As Clapton says though, dont roll over yet, get a copy of this agreement and check it - cant hurt to try.
Not seen the other threads, but Ill have a look and see where this puts you etc

How much of your expected 45K profit will go to RBOS?
Have you started the negotiations with any other creditors about settlement figures?
Lets see what new course of action we can all come up with - dont let this turn for the worse beat you - its just a 'blip' on your road to debt free.

I'm afraid that many mortgage agreements are framed in this way - so that any overdraft, loans etc.. you have with the bank that supplies your mortgage can also be secured against the property.
This is something that really should have been explained to you at the time you brought the property by either your solicitor or mortgage advisor.
does seem terribly unfair - you'd think that the banks would reward you for being loyal, and having both your mortgage and other debts/ accounts with them but unfortunately it is often the other way..

I have spoken to the head conveyancer at our solicitors today and he agrees it sucks. He gave Shakespeares Solicitors a ring at 9.15 today and phoned me back to say the solicitor at Shakespeares said he will have the figures ready for the completion date tomorrow.
About a third of the amount we owe goes to RBOS (approx £30000). We have been trying to phone CCCS since Monday but can't get through so I am going to email now and hope they are not too busy.
What really gets my goat is that I was told by the man in "Litigations" ...may his soul be torn apart by demons... that we had not made any payments (our £5 per month to each account via CCCS) since September! But we have never missed a month at all and the amount is showing on our monthly statement from CCCS as going out to RBOS.
So where is the money going?
Thats why I need to speak to CCCS so urgently. 0 -
Just had a phone call from our conveyancer. He has spent most of the day sorting this out for us. He spoke to numerous departments in RBOS and was eventually told that a redemption figure was sent to Shakespeares Solicitors on Dec 22!!!! To cap it all, Shakespeares denied receiving it when he spoke to them.
Incompetent or what :mad: :mad:
I have had to tell my boss to put me down for being off sick tomorrow as I feel so anxiuos about it all.
I suppose I should be grateful its all finally getting sorted....thanks to our Conveyancer:T0 -
CLAPTON...sorry, just realised I hadn't answered your question. I had a look on the land registry site but it costs £5 to view and I haven't got spare fiver til payday.
And I will be asking for a copy of the agreement.
And going after them for all our bank charges when its sorted.

Just a quick note about looking on the Land Registry site - it will tell you who holds a charge over your property, but not what type of charge (sounds as though you have signed an 'all monies' charge). So it would probably be a wasted £5, as you already know WHO has the charge. If you still have your original paperwork, the document you need will be called the 'Legal Mortgage' or 'Legal Charge'. If not, the bank should be able to provide you with a copy (although double check they wont charge you for this)."I wasn't wrong, I just wasn't right enough.":smileyhea97800072589250

Ok, lots of bad news, but there is some good....
At the end of all this, you will have paid off a third of your total debt and have around 15K in your pocket - thats not to be sniffed at.
I now its a shame you cant use all the money to settle the outstanding amounts, but lets try and concentrate on the positives (easy for me to say I know)
I think your best course of action will be to muddle through this horrendous mortgage thing and get RBOS out of your life once and for all.
Then, back onto this forum with a complete SOA and lets see how we can move forwards.
Im still sure there will be a light at the end of the tunnel !

Feel a lot better today. Probably helped by finishing a bottle of Creme de Menthe we got for Christmas and a lovely meal my DH cooked for me with defrosted Chistmas leftovers.
I will try to think positive.
By the end of today, a third of the debt will be gone and our disposable :rolleyes: income will be greater as there is no mortgage to pay. On the advice from a fellow MSEer on the Investment Board we will sell our underperforming endowment and plough that into the debt fight.
And I am going to try and figure out a way we could manage with one car but that could be a real problem as we both have to travel by car to work (no public transport and low local employment) and we work shifts.0
